This website is operated by Soul Scents. Throughout the site, “we”, “us” and “our” refer to Soul Scents. By visiting our site or purchasing from us, you agree to these Terms of Service and the policies referenced on this website.

1. ONLINE STORE TERMS

You must be at least the age of majority in your state or territory, or use this store with the consent and supervision of a parent or guardian. You must not use our products or website for any unlawful purpose or interfere with the security or operation of the website.

2. PRODUCTS AND INFORMATION

We take reasonable care to describe and photograph our candles, diffusers, room sprays and other products accurately. Colours and appearance may vary slightly due to lighting, screens, handmade production, or natural variation. Product descriptions, fragrances, availability and prices may change without notice.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

3. ORDERS

Placing an order is an offer to purchase. An order is accepted when we confirm it and receive successful payment. We may decline or cancel an order where a product is unavailable, information or pricing is incorrect, payment cannot be processed, or fraud is reasonably suspected. If we cancel a paid order, we will provide a refund.

Please review your order and delivery details carefully before submitting it. Contact us promptly if you need to request a correction; changes cannot be guaranteed after dispatch.

4. PRICES AND PAYMENT

All prices are displayed in Australian dollars unless stated otherwise. Free standard shipping within Australia is included where shown on the website. You agree to provide current, complete and accurate billing and payment information.

5. SHIPPING, RETURNS AND REFUNDS

Shipping and delivery are governed by our Shipping Policy. Returns, refunds and remedies are governed by our Return and Refund Policy. Delivery timeframes are estimates and may be affected by circumstances outside our reasonable control. Nothing in this section limits your rights under the Australian Consumer Law.

6. PRODUCT USE AND SAFETY

You are responsible for reading and following all product labels, safety instructions and care information. Candles must never be left unattended and must be kept away from children, pets, flammable materials and draughts. Diffusers and room sprays must be used only as directed and kept away from children, pets, flames, heat sources and surfaces that may be damaged. Stop using a product if it appears damaged or unsafe.

7. INTELLECTUAL PROPERTY

The Soul Scents name, logo, product photographs, graphics, written content and website design are owned by or licensed to Soul Scents. You may access the website for personal, non-commercial use. You must not copy, reproduce, distribute, sell or exploit our content without prior written permission.

8. THIRD-PARTY SERVICES AND LINKS

Our store is hosted by Shopify and may use third-party payment, delivery or technology providers. Third-party services and websites are governed by their own terms and policies. Soul Scents is responsible for sales made by Soul Scents; Shopify is not the seller of our products.

9. PRIVACY

Our collection and handling of personal information is described in our Privacy Policy. Shopify and other service providers may process information to operate the store, process payments, deliver orders and provide related services.

10. LIABILITY

To the maximum extent permitted by law, Soul Scents is not liable for loss caused by misuse of a product, failure to follow safety or care instructions, or events outside our reasonable control. This clause does not exclude, restrict or modify any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

11. CHANGES TO THESE TERMS

We may update these Terms from time to time by publishing the revised version on this website. The Terms applying to an order are those in effect when the order is placed.

12. GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and applicable Australian courts.
